Dekalb County Recorders Court Disadvantages Poor

I was recently amazed to read the mission statement on the Dekalb County Recorders Court webpage; “To provide efficient, ethical handling of all court cases with an emphasis on timeliness, quality customer service and accessibility.” My recent experience with Dekalb County Recorders Court leads me to believe this system is not efficient, it certainly is not timely, does not provide quality customer service, and is unfair by any standard especially for the working poor.

On February 2nd I was given a traffic citation for a crime I committed. The citation lists a phone number for an automated service to find out the fine. After several attempts to find out my fine using the automated system, I called the Recorders Court itself so I could speak to a real, live human. This second line was frequently busy and hold-times were often greater than a half hour. When I finally did speak to a real, live person I was told the ticket simply was not in the system and I would have to wait. With my court date on March 15th quickly approaching I started to get nervous. I called again on Friday, March 9th and the ticket still was not in the system. Finally, on Monday, March 12th the ticket was in and the fine far exceeded my ability to pay. This was especially true since I only had from March 12th to March 15th to come up with the money. Dekalb County had 25 working days to enter the ticket. I was left with 3 days to come up with the money. I am not exactly sure how this could ever be construed as timely, efficient, or quality customer service.

I am a student and my current salary is below the poverty level. Like many individuals in Dekalb County, I live from paycheck to paycheck and I am paid monthly. I decided to go to my court date hoping to earn some kind of reprieve. I had to find someone else to fill my position while I missed work. Any hopes of getting leeway were quickly dashed.

There were several things that happened during my appearance in court that both surprised and angered me. First, without the judge ever leaving his chambers, the court clerks announced that everyone there would be offered a plea deal. Points were significantly reduced, but we were all still responsible for the full fine. If one positive thing came out of the entire experience, it is that my points were reduced to zero and my insurance company will never know about the ticket. I found the end result of going to court is three hours or so of wasted time, considerable belittling by the court clerks (a topic I’ll get to shortly), but at least your insurance will not go up.

Now, about the belittling. I was shocked at the clerks’ treatment of the individuals in the courtroom. First, one of the clerks frequently tried using intimidation. He would repeat over and over that cell phones were not allowed in court and that the judge had the right to put us in jail for two days if we used cell phones. He also repeated over and over that we would have to post a cash bond if we were caught talking. His tone was incredibly derogatory. I was angered to watch the officers of the court holding side conversations while those of us in the court were being treated like children. The one act of intimidation that angered me the most related to a sheet of paper where individuals in the court must enter their plea of guilty, not guilty, or nolo contendere. This same clerk continued to belittle us by constantly repeating that the judge was not a lenient person, and that we must have the sheet completely filled out or the judge would be very angry and short with us. An individual finally worked up the courage to ask the clerk “what does nolo contendere mean.” The clerk looked at her and told her the judge would explain the form. Almost comically, the individual responded back to the clerk, “if you won’t explain what it means, then how can we fill out the form?” The tone and the constant repeating of threats of jail time and greater fines smacked of intimidation with the purpose of encouraging people to take the plea deal and leave the court before the judge left his chambers.

Unfortunately, there were many people in the court that day in a similar situation as me; they were unable to pay the fine. I can only imagine that many of these people would have liked to have paid their fine, but were unable to do so because, like me, they only had 3 days to come up with a large sum of money. For those of us in this situation, we were offered parole. For an extra $34 per calendar month we could go on parole and have 120 additional days to pay the fine. It is important to note that “per calendar month” is a real sneaky trick. What this means is, if you go on parole on March 30th, you owe $34 for March, and then on April 2nd you owe $34 again. Yes, $34 for a weekend. If I were a paranoid individual or a conspiracy theorist, I would guess the people that enter the tickets are in cahoots with the individuals who run the parole business. The ticket entry people get some kickback for being slow and helping to make sure more people end up on parole.

This situation I am writing about is more than just frustration and annoyance. For starters, the complete lack of timeliness in entering the tickets disadvantages the disadvantaged. Anyone living from paycheck to paycheck is unlikely to be able to gather up the money to pay a traffic ticket with only three days of notice. Furthermore, these individuals who cannot pay the fine quickly are charged even more via the parole racket.
Finally, when academics study fairness in organizations and judicial systems, they look at multiple factors. One of the advantages of our judicial system over that of what is used in many parts of the world is that we can hire our own representative and we have some control over the evidence presented. In other words, we have some procedural control that, regardless of the outcome, makes our system fairer than other systems. Beyond procedural control and the final outcome is also something called interactional justice, or the fairness of how you are treated by the agents (police, clerks, judges) of the judicial system. My experience with the Dekalb County Recorders Court leads me to believe there is no justice in the system. For being poor, I was given a greater fine than someone who is not poor through the parole system. Not only that, the lack of timeliness and lack of efficiency speaks to bad procedures in place for entering tickets. How could it possibly be fair that Dekalb County gets 25 business days to enter a ticket and then the suspect has only 3 days to gather up the money? Finally, with the belittling and intimidation tactics used by the clerks, the agents of the judicial system, I see very little interactional justice.

I am currently working to share this experience and these thoughts with as many people as possible. I doubt this system will change, and I will likely so no direct payback for my efforts. But I do hope to harass the agents of the system and inform the people Dekalb County about the kind of trouble they could run into if they are poor.

The traffic judicial system is completely screwed up in Georgia, it needs to be completely fixed.
 
It sure seemed sleazy to me.

I ended up e-mailing a couple of people. I was told that they saw no problem with how people are treated in the court. And secondly, there is no problem with how long it takes them to enter a ticket into their system. Frankly, it would appear as though they just do not care.

I also sent some editorial versions of my comments to The Dekalb County Neighbor and the AJC. As far as I know, they have no interest in this kind of story either.

I like that my blog gets more hits for my traffic citation in Dekalb county than for anything else. At least a few people might benefit by knowing about what so many of us have been through.
 
dekalb county traffic court is BS. never get a ticket in dekalb county.
experience #1 i got a ticket in doraville (dekalb county) and lost the ticket. called to find out when my court date was and they couldn’t find it in the system, they told me it tkes awhile to enter in the system, try back in a few weeks. went to the office in person, same thing. finally found out that doraville has a separate court system (no the systems are not EVEN LINKED) and already i missed my court date, had to pay the fine.
experience #2 got a ticket by the farmers market. remembering the incident from a few years prior called both dekalb county and clarkston–nothing. they gave me sme story about it may take awhile, kept trying back. got referred to a few other local cities, still nothing. finally discovered my ticket was in decatur. luckily made my court date. city of decatur judge was cool. easy breezy. got lucky
experience #3 ticket for dekalb county recorders court. GRRRRRR, yes, people spilling out the building. court date rescheduled. forgot to go back. big fine now.
i take responsibility for losing my tickets and not remembering my dates (hell, they give you court like 3 months later so I don’t know how anybody with a life is supposed to remember that), but I still tke responsibility. I gotta get my stuff together :) BUT, why do they have all these separate jurisdictions and no UNIFIED computer system. and why are people always spilling out the courthouse?

Welcome to the justice system! It's supposed to be tough for a reason. Adults keep up with their court dates, fines and tickets. Your mama ain't here to take care of you anymore. Don't get any more tickets!
 
It is supposed to be fair. You are also innocent until proven guilty. Treating someone badly because they might be guilty doesn't cut it.

I break traffic laws all the time: mostly speeding (and in Atlanta you will be run over if you don't speed). I do keep up with the tickets when I get them (haven't had one since this occurred years ago). It has never been a problem anywhere else I have ever lived (specifically Indiana for more than a quarter of a century). But I've also gotten tickets in Fl, Ny, and Ky. Never had a problem until the crooked Dekalb County system.

It can't be my fault that I cannot pay a ticket if it isn't in THEIR system. It is THEIR problem.
 
David sounds smart... It is Friday, my court date is Wed, and the courthouse closes at 4:30, luckily I don't work 9 to 5. I have been calling for hours and it is just a busy signal so I tried to find my citation online and they don't have anything for me(imagine that). I know when my court date is and have my ticket, I am trying to "keep up" with my fine but cant. So yes David in a perfect world there would be no judiciary needed at all, but as for reality it is slightly frustrating to not be able to find out how much you owe for running a stop sign hidden behind some foliage.

I HAVE NOTHING GOOD TO SAY ABOUT THE RECORDERS COURT...ALL MY EXPERIENCES THERE HAS BEEN NEGATIVE THUS FAR...FRANKLY, I THINK IT IS A CONSPIRACY BETWEEN THE POLICE OFFICERS, THE JUDGES AND WHOMEVER IS RESPONSIBLE FOR SOLICITING REVENUE FROM THE PUBLIC FOR THE COUNTY'S PURSE.
 
Dekalb County recorders court/traffic tickets system is like a giant criminal enterprise. No published fines for the traffic offenses (guess they make up the dollar amount each day depending upon how overspent their budget is), can't get fine amount until just before court date, bribe given at court to plead guilty and pay the fine, etc. Where is 60 Minutes when you need them or Michael Moore as this would make one hell of a mmovie?
 
Dekalb Co. Recorders is twice as horrible as what was mentioned above. Rescheduled dates are the norm, as if it's no problem getting off of work repeatedly for a ticket. I do believe that they're in cohoots with the probation office also, as they push probation off onto you and make you feel like you have to pay it, not mentioning any other means of taking care of the fine such as community service. Sadly they can't even keep up with who's paying their tickets and probation fines, which is unfair to the people that actually do pay them. The whole dam court should be overthrown, entire staff replaced and or retrained, they need a new updated computer system, & new officers and judges! Its past frustrating. Its hard to believe that they actually get away with all of these issues as if its no big deal. I guess no one cares.

I think we all need to get together and do something. I had a similar situation the other day. showed up in court thinking that would help my case, and I was slammed with a $390 (speeding in a school zone + increase due to history with previous tickets, but he gave a warning for my late vehicle registration( only 2 days late btw). what is annoying is that it is all splitting hairs. The school zone was ill-marked + the ticket time read: 2:32 pm (2 minutes into the school zone time). Not only that but I was told that the ticket cost would increase now 40%. I also was told that my ticket amount was increased because of previous driving record- I HAVE NOT HAD A MOVING VIOLATION or ANYTHING in almost 5 years!! WHAT!! I get to the cashier and my $390 is not increased by 40% (due to new state mandations??) but 50% because I was in a school zone. it was brought to - what she said $590 (which by the way she quoted me the wrong amount, and I double checked and she still quoted me the wrong amount!!. I go to pay with a credit card and they get me for another $39!! THEY ARE CROOKS & SCAMMERS.

I also experienced the "bribe" = we will reduce your speed by 10 and thus not report you to the insurance company but you will need to pay the full fine! that is intimidation and bribary = illegal.

truly, something needs to be done about this. letters in abundence to the AJC, the news network! in this economy i know cities and states are having a hard time, but that is not a reason to ever act unfair, rude and unethical. they are doing this one citizen at a time; and we need to get together as a group and change what has happenend and get reimbursed. to pay $600 for a speeding ticket- when I was only going 42 in a typical 35 zone is rediculous! and personally we cannot afford to be charged like that and/or be taken advantage like this. it was and is insulting!!
 
Has anyone considered a class action suit against Dekalb Couny? I have recently discovered that many, many people have shown up for their appointed court date, paid their fine, and then months later received a notice that they are in contempt for missing their court date and not paying their fine. Some kept their receipt of payment, some didn't. If you could prove that you paid, the situation was corrected. However, you still had to wait 2 hours in line to prove this. Additionally, if your receipt was too old and not readable, too bad for you. They have done this to hundreds of people-sounds like money laundering, conversion or simple theft of the thousands of untraceable cash dollars that comes through their irresponsible hands everyday.
 
Someone should investigate the link between the "Judicial Correction Services,Inc. Who owns it and possible links to high ranking DeKalb County Police officials. This company not only launders money for the court system..but may have illegal connections to County officials...My Shit..Macabelli
 
how do we fix this? how do we get the AJC to do an investigation and run some press on the situation?

so please, macabelli & reily..how do we go about a class action, and/or investigation. I neither have the money at the moment nor a lot of time.. but I do have persistence and drive. & when something is unethical and outright illegal- I will not sit on the sidelines.

please..how does one go about this? have you guys done this before. are you guys interested in doing something here?
 
I AM CURRENTLY GATHERING INFO FOR CHANNEL 2 TO DO A WHISTLE BLOWER STORY..THIS IS A START...CLASS ACTION WILL COME LATER....FIRST THING TO DO IS START A PETITION...PLENTY OF CANDIDATES IN THOSE LONG TRAFFIC COURT LINES THAT GROW LONGER DAILY..HAS ANYONE NOTICED THE NEW PAID PARKING ARRANGEMENT....LOL

I have not noticed the new paid parking arrangement- but I am sure too- that it is absolutely ludicris. (parking meters are pretty petty too- :-) what 25 cents buys 5 minutes! hahaha! and who carries that change around town?)
 
What DeKalb County Traffic Court is doing to its residents amounts to Gang Rape by the judicial System...and you know they did'nt have the decency to use a damm condom. Those amongst us that has been savagely violated by this mob need to let your voices be heard..We need to organize a protest...Email me your contact info so I can get this movement going. "Nuff Shit..No Justice"

And the evidence in the local media keeps stacking up even though they often won't report on the fallacy of most individual cases (http://www.cbsatlanta.com/news/23546495/detail.html).
I hope Withers can get this sorted out but it is going to be one heck of a job to fix a system that is rotten to the core.

Since I wrote this I've been shocked at the impact. I had no clue this system was so erroneous. I've also sent brief write ups to the AJC, Dekalb Neighbor, and several TV stations. They do not appear to care for the most part.

I've also had the chance to speak with some officers who serve this court. In short, they hate it. I personally like police officers and greatly respect the job they try to perform. When they HATE the court responsible for handling executing justice, I think that says something.

I just e-mailed, Rick, the auther of the recent dekalb county injustice. I wrote to recommend that more research and articles be done by him to expose the unjust dekalb county- city of decatur court house. I hope this helps with our efforts. what is happening with channel 2 news? How about the Sunday Paper or Creative Loafing?

I went up to the court today to reschedule a court date (failure to get a GA license in lieu of my CA one) for Thursday and they told me there is a minimum 7 days notice. My boyfriend rescheduled his court date the day before in Dunwoody.

And that's what I said I was just in the parking lot for free in March, and now all 3 lots are $3 parking. Are you serious?
 
JCS is a company that is crooked as hell. I worked in the AL. offices. They have a regional manager that have been sexually harassing females and firing them under suspicious circumstances for years. The company has no official sexual harrassment policy and covers it up. They also has had office managers trading drugs for probation fees. They need to be investigated. They have problems with massive thefts with one manager stealing well over $100k. Since they are incorporated in GA. I think I am giving you enough for someone to start an investigation there. I am here. It's time to drain to the swamp.

Your problem is not Dekalb and the fact that you got the ticket. You want to bring up the fact that you are getting charged probation fees and if you don't pay your fees then you will be placed in jail, which is unconstitutional. As a former JCS employee, we act as debt collectors, not probation officers. That's the story you want to communicate to people.
 
This court is a joke! Using the economy as an excuse for this courts LAZINESS and CARELESSNESS is crazy! I recently moved to metro Atlanta from metro Detroit, where the economy is WORSE and I never had to deal with the BS there with ANY court system like Dekalbs. After going to my scheduled court date I was told to go home and I would recieve another courtdate in the mail...hmm that was 2/3/11 and today would be 04/21/11 and still nothing has came. I try calling the court every single day and never is lucky enough to get through. I cant believe the people in charge over the courts employees allow such carelessness and pure stupidness in a govt. building.
 
Just got a citation this morning. Didn't noticed the sign that indicated no u turn and made a u-turn there. Plan on showing up in court to see if judge will give me a break. Well aware now that I made a u-turn in the wrong place and that I am "guilty". However, it wasn't intentional, and I am human and make mistakes like everybody else. I believe I should be given a second chance.
 
And by the way David, it sounds to me that the people here have been "keeping up" citations and court dates and blah, blah, blah. It appears the court is having problems keeping up with this shit.

THIS IS ABSOLUTELY BANANAS !!!! I too have been caught in the matrix of B.S with Dekalb Co Recorder's Court... Mine is for Insurance Had 24hr lapse that wasn't going to go into affect until midnight that night, and just my luck I'm approaching the light by Dekalb Tech on Memorial Dr the car behind me decides to move over and viola! A sherriff appears, runs my tags, hits the light and pulls me over. It was also my B-day of all days!!!! At the time I had not moved to GA yet still lived in NC *importance of that in a moment* So gives me the run down about how he's supposed to have my car impounded and etc. but lets me off b/c its my B-day...(not impressed, still gave me the damn ticket) Fast foward , court was 4/14/11 went to court and was told it would be rescheduled...WTF its just an insurance ticket WHY RESCHEDULE?!?!? ------------> Soooo I'm officially moved and settled in May...still no court date. I'm thinking maybe they sent it to the NC address so I went up there to give my new Address. June...nothing. July...nothing. August...nothing. After repeated attempts to reach them I went to the website and sent an email Go figure they respond in 24hrs :0( only to tell me that my court date was this past 9/21/11 !!!!!!!!! So now I have to appear in FTA (Failure To Appear) Court on Friday Morning ANDDDDDD That's still not a guaranteed stand with the judge b/c get this...ITS FIRST COME FIRST SERVE 0_0 I am never going to live in Dekalb County and I have no reasons to be in their county what-so-ever. Its been such a horrible experience. I have never had issues like this. Not to mention they treat traffic court like Criminal Court...Its retarded

THE STATE OF GEORGIA, WELL ATLEAST THE METRO ATLANTA AREAS ONLY WANT TO GET A CONVICTION AND MAKE YOU PAY A FINE. THEY WANT YOU TO PLEA OUT AND WILL OFFER YOU A LESSER OFFENSE IF YOU AGREE TO PLEA OUT. THEY DONT WANT YOU TO EVER FIGHT FOR YOUR RIGHTS OR TO EVER GO TO TRIAL. KNOW YOUR RIGHTS AND MAKE SURE YOU MAKE INTELLIGENT DECISIONS. YOUR DECISION CAN AND WILL AFFECT YOUR FUTURE.
 
How do I get in contact with any of you! I think that we should form some type of alliance or organization to go against them. They are awful. They get so much money from state tax... which all states don't charge AND collecting crazy money from late fees which were caused by them in the first place. I am going through the same thing! I can't even contact them to find out how much the ticket is!
 
I was rear-ended on my motorcycle at a red light in Dekalb county in May. I saw the kid coming and knew he wasn't going to stop because he was LOOKING DOWN IN HIS LAP.....TEXTING!!! I relayed that info to the cops. Their incompetence led to charging him with following too close. He wasn't following anything. I was stopped - he slammed into me. Wreckless driving should have been the charge at the very least. Then as I'm laying in the grass injured the idiot cops are standing over me demanding that I move my 700 pound bike out of the intersection. Yeah, fool, I'm going to pick up a 700 pound bike and move it. YOU MOVE IT IDIOT!! Took four of them to pick it up and move it. Dekalb County cops are completely and totally incompetent. Cannot even handle a simple rear-end accident!
 
FATHER OF THREE IN DEKALB COUNTY,TAKEN ADVANTAGE OF BY PROBATION OFFICER.WAS SENTENCE TO 12 MONTH PROBATION FOR A 252 TRAFFIC TICKET.HAVE PAYED 180.00 AND PROBATION OFFICER STILL KILLING ME WITH PROBATION FEES,NOW I'M TOLD I STILL OWE 180.00.WHICH I DON'T HAVE PAYING RENT.AND DAY CARE. I TRIED EXPLAINING MY SITUATION AND WAS ORDER TO GO BACK TO COURT FOR VIOLATION ON A TRAFFIC TICKET.OR PAY BEFORE court
 
It is all a scam to get additional funds for Dekalb County. I had a $400 fine which I was unable to pay and placed on probation. I explained to the probation officer I am on disability. I had been an observer in court and noticed a few things about the system. The officer should allow you to fill out a hardship form and provide evidence. If you are legitimately unable to pay due to your resources, your fine can be converted to community service. You can pick the place to conduct your CS as long as it is not a place where there are children or a church. I would rather do community service any day than give Dekalb County one penny. The Probation Officer had the CS approved but would not allow me to start until I paid a $15 insurance fee. I asked to go to court. The judge has the ability to waive fees as long as you have filled out the hardship forms. Many Probation Officers will not tell you about the hardship form. The most important thing to remember is go to ALL your appointments and if you can't pay, ask for a hardship form. If they demand more money from you, ask to be sent to court. The judge waived all my fees and fines and gave me 22 hours CS. I completed my CS, went back to probation and they demanded MORE money ! I told them they were violating the judge's order. They didn't care. I went back to court and the judge closed my case and said they violated her order. Most people would have paid the extra money to close their case but I am firm in not giving my money to them. The CS I did was well worth it.
 
I agree with everyone's sentiments regarding DeKalb County Recorders Court and even more so with the city of Clarkston, GA (within DeKalb County). I've been trying to figure out how to out these departments for their actions. I have a long story which I can't post now, I'm running late but I will come back to explain.
